Terms of Service

These terms are an agreement between you and [[COMPANY LEGAL NAME]] (registration number [[CIPC REG NUMBER]]), trading as SocialBoost ("SocialBoost", "we", "us"). By creating an account or using socialboost.co.za you agree to them. If you don't agree, don't use the service.

1. What SocialBoost does

SocialBoost is a marketplace. Brands, artists and businesses ("Brands") post paid promotion campaigns. Independent content creators ("Creators") apply to promote them in posts on their own social media accounts. We verify Creator accounts, hold campaign payments, release payment once a post is approved, and pay Creators.

We are not an advertising agency and we don't create content. Each campaign is an agreement between the Brand and the Creator, which we facilitate. We do not sell followers, likes, views or any automated or fake engagement.

2. Accounts

You must be 18 or older and able to enter a binding contract. You must give accurate information and keep your password private. You're responsible for everything done through your account. One person or business may hold one account of each type.

3. Creator rules

As a Creator you confirm that you own or are authorised to manage every social media account you list, and that its followers and engagement are genuine. Accounts with bought followers, bot engagement or engagement pods may be removed without payment for affected campaigns.

For every accepted campaign you must:

Creators are independent contractors, not employees or agents of SocialBoost or the Brand. You are responsible for your own tax, including income tax and, if you are registered, VAT.

4. Brand rules

As a Brand you confirm that what you promote is lawful and that you have the right to promote it. You may not use SocialBoost to promote:

Your brief must be honest. You may not ask a Creator to hide that a post is paid, to make claims you know to be false, or to break platform rules.

5. Payments, holding and fees

Funding. A Brand funds a campaign in full before Creators can apply. Payment is processed by PayFast or PayPal. We never see or store full card numbers.

Holding. We hold campaign funds on the Brand's behalf until they are released to a Creator or refunded. Funds held are not SocialBoost's income.

Our fee. When a Brand accepts a Creator's offer, the offer amount is reserved from the campaign budget. When the post is approved, SocialBoost keeps [20]% of that amount as its finder's fee and the Creator receives the rest. Prices are shown in South African rand. If we become VAT-registered, VAT will be shown on invoices.

Approval. After a Creator submits a live post, the Brand has 7 days to approve it or request changes. If the Brand does neither, the post is approved automatically.

Payouts. Approved Creator earnings are paid weekly by EFT to a South African bank account or by PayPal, using the details in the Creator's profile. You're responsible for giving correct payout details. We may delay a payout while we investigate suspected fraud or a dispute.

Refunds. When a Brand closes a campaign, any budget not reserved for accepted Creators is refunded to the original payment method within 14 business days. Reserved amounts for posts that never go live are returned to the budget. Fees on approved posts are not refundable.

Chargebacks. If a Brand reverses a payment after Creators have posted, we may suspend the account and recover the amount owed.

6. Disputes between Brands and Creators

If a Brand believes a post doesn't match what was agreed, it must request changes before approving, explaining what is wrong. The Creator may fix and resubmit. If the two can't agree, either can ask us to decide by emailing info@socialboost.co.za. We'll review the brief, the offer, the post and any messages, and decide whether to release, partly release or return the payment. Our decision on held funds is final for the purposes of the platform. It doesn't take away any rights you have under law.

7. Content and licences

Creators keep ownership of the content they make. By accepting a campaign, the Creator gives the Brand a non-exclusive, royalty-free licence to share, repost and link to the published post on the Brand's own social media and website for 12 months, with credit to the Creator. Any other use, such as paid ads, TV or print, needs a separate written agreement with the Creator.

You give SocialBoost permission to show your public profile, profile photo, platform handles and follower counts on the site to help match Brands and Creators.

9. Suspension and closing accounts

You can close your account at any time by emailing us. Campaigns already funded or accepted are settled first. We may suspend or close an account that breaks these terms or the law, or that puts other users at risk. Where reasonable, we'll tell you why and give you a chance to respond.

10. Liability

We don't guarantee any particular number of views, sales, followers or other results from a campaign. Results depend on the Creators, the content and the platforms, which we don't control.

To the extent the law allows, our total liability to you for any claim is limited to the fees SocialBoost earned from you in the 6 months before the claim. We are not liable for indirect or consequential loss, or for the actions of platforms such as TikTok, Instagram or YouTube. Nothing in these terms limits rights you have under the Consumer Protection Act or other law that can't be excluded.

11. Privacy

How we handle personal information is explained in our Privacy Policy.

12. Changes

We may update these terms. We'll email account holders at least 14 days before a material change takes effect. Continuing to use SocialBoost after that means you accept the new terms.

13. Law and contact

These terms are governed by the law of the Republic of South Africa.
